When a vehicle loaded with cargo is transported by sea, rail, inland waterways or air and the cargo is not moved the CMR convention is applied to the entire freight process. Thus, the road carrier is not held accountable in accordance with the CMR convention and the imperative regulations that stipulate accountability of a carrier of a respective means of transportation, in accordance with the freight agreement, are applicable only in those cases when the carrier is able to prove that the loss of, damage to or lateness in delivery of cargo occurred when transporting the cargo by means other than road and the road transportation carrier cannot be held responsible, because the fault is of a carrier using a different means of transportation.
