Directive 98/44/EC encourages investment into the biotechnology sector and secures legal protection of such investment into research and development. Regija Borenius offers consultation on legal issues concerning such investment, as well as protecting the results of research.

 

 

 

 

Biotechnology is an especially dynamic sector. Its rapid expansion is creating more and more opportunities for new products and services in the fields of agriculture, ecologic agriculture, and pharmaceuticals among others. Directive 98/44/EC opened up the possibility to encourage investment in the field of biotechnology and at the same time to ensure adequate legal protection in order to successfully perform research and expansion.

 

Consultation on investment issues as well as questions related to the analysis of the possibility of patenting inventions in the field of biotechnology requires special expertise. The practice group of Regija Borenius specialising in the biotechnology sector has amassed substantial experience in the field of genetically modified organisms. We consult companies, research institutions, investors and other legal entities and persons in all fields of biotechnology, from pharmacy, chemistry, agriculture, genetically modified organisms, plant biotechnology to bioethics.

 

Regija Borenius consults on all questions related to intellectual pharmaceutical property, prepares license and other agreements. We consult pharmaceutical companies, institutions and agencies that carry out research as well as other legal entities and natural persons on legal questions related to the registration of medicines and market entry, advertisement of medicines, issue of appropriate licences, import of medicines from non-EU countries, and regulation of biomedical and clinical research.

Representative Transactions

 

In 2004 Regija Borenius was expert advisor to the Ministry of Environment of the Republic of Lithuania in the EU PHARE project Strengthening of the Institutional Capacity for Implementation of the EU requirements in the GMO, IPPC, Chemical substances and greenhouse gas sectors of Lithuania. Under the auspices of this project Regija Borenius:

 

  • Evaluated legislation of the Republic of Lithuania with respect to Directives 67/548/EEC and 1999/45/EC related to chemical substances.
  • Evaluated legislation of the Republic of Lithuania with respect to Directives 90/219/EEC and 2001/18/EC related to genetically modified organisms.
  • Drafted the Law on Genetically Modified Organisms and the description of the procedure regarding the deliberate release and marketing of the genetically modified organisms.
  • Consulted specialists of the Ministry of Environment on issues related to the preparation of legislation on GMOs.
